Terms and Conditions of Payment, Cancellation, and Refund - Effective Period: 2025 – 2027

 1.⁠ ⁠Reservations and Deposits

All tour reservations with Bird Uganda Safaris Ltd shall be confirmed upon receipt of a non-refundable deposit equivalent to 20% of the total tour cost, exclusive of certain activities such as Gorilla and Chimpanzee tracking permits, the full payment of which is required at the time of booking and in addition to the deposit.

The outstanding balance of the total tour cost must be paid no later than sixty (60) days prior to the scheduled tour departure date. All payments must be made in United States Dollars (USD).

 2.⁠ ⁠Trip Cancellation and Refund Policy

All cancellation requests must be submitted in writing and shall be governed by the following refund schedule:

•⁠ ⁠More than 50-60 days prior to the tour commencement: 75% of the deposit will be refunded.

•⁠ ⁠49 to 40 days prior: 40% of the deposit will be refunded.

•⁠ ⁠Less than 30 days prior: No refund shall be issued.

Once the tour has commenced, no partial or full refund shall be provided for unused services or for any participant who voluntarily leaves the tour or is removed under the provisions of Clause 3 below.

Travel Insurance: All clients are strongly advised to purchase comprehensive travel insurance, including trip cancellation coverage, to protect their investment.

 3.⁠ ⁠Medical and Health Requirements

Participation in tours organised by Bird Uganda Safaris requires a reasonable level of physical fitness and good general health. All clients are required to disclose in writing any known medical conditions or dietary restrictions well in advance of the tour.

The appointed Tour Leader reserves the right, at their sole discretion, to decline or terminate the participation of any individual who, due to medical, physical, or behavioural reasons, may jeopardise the safety or enjoyment of the tour for themselves or others. No refund shall be provided in such cases.

 4.⁠ ⁠Changes to Itinerary and Delays

Bird Uganda Safaris reserves the right to alter, amend, or adjust tour dates, itineraries, accommodations, or transportation arrangements where circumstances so demand, including but not limited to weather conditions, road closures, flight delays, or other operational disruptions beyond our control.

In the event of delays or modifications resulting from force majeure, the resulting costs shall be borne by the client. No refunds shall be issued for such changes.

 5.⁠ ⁠Cancellation by the Company

Bird Uganda Safaris reserves the right to cancel any tour prior to departure in the event of insufficient enrolment, political instability, natural disaster, epidemic, or any other cause deemed to make operation of the tour inadvisable.

In such cases, all refundable monies paid shall be refunded in full, which shall constitute the full extent of the Company’s liability. Bird Uganda Safaris shall not be held liable for any expenses incurred by the client in preparation for the tour, including but not limited to non-refundable airline tickets, visa fees, clothing, equipment, or other associated costs.

 6.⁠ ⁠Limitation of Liability

Bird Uganda Safaris, its directors, agents, and employees act only as agents for the transport companies, hotels, lodges, and any other service providers involved in the client’s travel arrangements. The Company accepts no liability for injury, death, loss, damage, accident, delay, or irregularity arising from any cause, including but not limited to:

•⁠ ⁠Acts of God

•⁠ ⁠War, civil unrest, terrorism, and hostilities

•⁠ ⁠Quarantine or pandemic

•⁠ ⁠Government restrictions or regulations

•⁠ ⁠Delays or failures in transportation

•⁠ ⁠Negligence of third-party suppliers

Reasonable adjustments to the itinerary may be made in the interest of client safety and comfort.

 7.⁠ ⁠Force Majeure

Bird Uganda Safaris shall not be held liable for failure to perform its obligations where such failure arises from unforeseen events including, but not limited to, acts of war, natural disasters, civil disturbances, government-imposed restrictions, or pandemics.

In such cases, the Company shall notify affected clients at the earliest opportunity. Clients affected by a force majeure event shall be entitled to a credit note equivalent to monies paid, valid for a period of one (1) year from the date of issuance.

 8.⁠ ⁠Dispute Resolution

In the event of a dispute or grievance arising during the course of the tour, the aggrieved party shall immediately notify the Bird Uganda Safaris head office or their designated representative in order to seek an amicable resolution.

 9.⁠ ⁠Governing Law

These Terms and Conditions shall be governed and construed in accordance with the laws of the Republic of Uganda. All clients shall be required to comply with the applicable laws and regulations of the Republic of Uganda during the course of their visit.

10.⁠ ⁠Acknowledgement and Acceptance

By submitting a reservation and deposit, the client affirms that they have read, understood, and agreed to be bound by the above Terms and Conditions. This agreement shall be legally binding upon the client, their heirs, successors, and assigns.
